This Privacy Policy (“Policy”) describes how NightSpark (“NightSpark,” “we,” “us,” or “our”), operating the website located at nightspark.ai (the “Site”), collects, uses, discloses, and otherwise processes personal information in connection with our Site and AI-powered tools and services (collectively, the “Services”). By accessing or using the Services, you agree to this Policy. If you do not agree, please do not use the Services.

1.1 Information You Provide

  • Account Information. If you create an account or sign in via Google OAuth, we may collect your name, email address, and profile picture as provided by Google.
  • User Input. Text, prompts, and other content you submit to our AI-powered tools in order to generate outputs.
  • Communications. Information you provide when you contact us at legal@nightspark.ai.

1.2 Information Collected Automatically

  • Usage Data. We collect information about how you interact with the Services, including pages visited, features used, timestamps, referring URLs, and general interaction data.
  • Device Information. Browser type and version, operating system, device type, screen resolution, and language preferences.
  • IP Address. Your Internet Protocol address, which may be used to approximate your general geographic location.
  • Cookies & Tracking Technologies. We use cookies, pixels, and similar technologies. See Section 4 below for details.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Services;
  • Process your inputs through third-party artificial intelligence model providers to generate outputs;
  • Authenticate your identity and manage your account and credits;
  • Analyze usage trends and measure the effectiveness of the Services through analytics tools, including Google Analytics;
  • Communicate with you regarding your use of the Services, including responding to inquiries;
  • Detect, prevent, and address fraud, abuse, security incidents, and technical issues;
  • Comply with applicable legal obligations.

3. Third-Party AI Model Providers

The Services utilize multiple third-party artificial intelligence model providers to process your inputs and generate outputs. When you submit content to our tools, your input may be transmitted to one or more of these providers for processing. Each provider operates under its own privacy policy and data handling practices. We select providers that maintain commercially reasonable security standards; however, we do not control and are not responsible for the data practices of these third-party providers. We encourage you to avoid submitting sensitive personal information, confidential data, or protected health information through the Services.

4. Cookies & Analytics

4.1 Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC, to collect and analyze information about use of the Services. Google Analytics uses cookies and similar technologies to collect data such as how often you visit the Site, which pages you view, and what other sites you visited prior to coming to the Site. Google Analytics collects the IP address assigned to you on the date you visit the Site but does not collect your name or other personally identifying information. We use the information gathered by Google Analytics to improve the Services. Google’s ability to use and share information collected by Google Analytics is governed by the Google Privacy Policy and the Google Analytics Terms of Service. You may opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

We use essential cookies to maintain your session and authentication state. These cookies are strictly necessary for the operation of the Services and cannot be disabled.

  • Third-Party AI Providers. As described in Section 3, your inputs are transmitted to third-party AI model providers for processing.
  • Service Providers. We may share information with vendors and service providers who perform services on our behalf, such as hosting, analytics, and payment processing.
  • Legal Requirements. We may disclose information if required to do so by law, legal process, or governmental request, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business Transfers. In connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction.

6. Data Retention

We retain your personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Generation history and inputs may be retained in association with your account to provide the generation history feature. You may request deletion of your data by contacting us at legal@nightspark.ai.

7. Data Security

We implement commercially reasonable technical and organizational measures designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security. You use the Services at your own risk.

8. Children’s Privacy

The Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete such information promptly. 9. International Users

The Services are operated from the United States. If you access the Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other jurisdictions where our service providers operate.
